Understanding Hemp

Hemp is cannabis. The word β€œhemp” usually describes cannabis that meets a legal Delta-9 THC limit, but hemp products can still contain many different cannabinoids and may affect people differently.

Start With the Basics

What Is Hemp?

Hemp and marijuana are not completely separate plants. Both are forms of cannabis, but laws usually separate them by Delta-9 THC content.

Hemp Is Cannabis

Hemp comes from the cannabis plant. It may contain CBD, THCA, Delta-8 THC, Delta-9 THC, Delta-10 THC, and other cannabinoids.

The Legal Definition Matters

In the United States, hemp is generally defined by a low Delta-9 THC concentration. State rules may be stricter or different.

The Label Matters More Than the Name

A product labeled β€œhemp” may be non-intoxicating, mildly intoxicating, or strongly intoxicating depending on the cannabinoids and amount.

β€œHemp” Does Not Always Mean Non-Intoxicating

Some hemp-derived products contain intoxicating cannabinoids. Always check the exact cannabinoid, amount per serving, and total package amount.

Common Cannabinoids

What You May See in Hemp Products

Different cannabinoids can produce very different experiences.

CBD

Cannabidiol

CBD is generally considered non-intoxicating. It appears in oils, gummies, capsules, beverages, flower, and topical products.

Delta-8 THC

Usually Intoxicating

Delta-8 THC may produce psychoactive / intoxicating effects. Strength and product quality vary widely.

Delta-9 THC

The Main Intoxicating THC

Delta-9 THC is the best-known intoxicating cannabinoid in cannabis. Hemp products may contain legally permitted amounts under some rules.

Delta-10 THC

Another Intoxicating Cannabinoid

Delta-10 THC is sold in some hemp markets. Research and product consistency are limited compared with traditional Delta-9 products.

THCA

Changes When Heated

THCA is found naturally in raw cannabis. When smoked, vaped, or otherwise heated, much of it converts into Delta-9 THC.

CBG and Others

Less Familiar Cannabinoids

Some products include CBG, CBN, CBC, or blends. Their effects may be less predictable and less researched.

Product Types

Common Hemp Products

πŸ’§

Oils and Tinctures

Liquid products taken by measured drops or droppers. Check the amount per serving and per bottle.

🍬

Gummies and Edibles

May contain CBD, Delta-8, Delta-9, Delta-10, or blends. One package may contain many servings.

🌸

Flower and Pre-Rolls

May be CBD-rich flower or THCA flower. Heating THCA can create an intoxicating Delta-9 THC experience.

πŸ’¨

Vape Products

Cartridges and disposables may contain concentrated cannabinoids. Strength can be much higher than expected.

🧴

Topicals

Creams, balms, and lotions are applied to the skin. Read the label to understand intended use.

πŸ’Š

Capsules and Softgels

Usually provide a fixed amount per capsule and are swallowed like a supplement.

πŸ₯€

Drinks and Mixes

May be ready-to-drink or added to water. Check whether the container is one serving or several.

πŸ§ͺ

Concentrates

Wax, distillate, resin, and other concentrates may contain high cannabinoid amounts and require suitable devices.

1

Name the Exact Cannabinoid

Do not rely on the word β€œhemp.” Check whether the product contains CBD, Delta-8, Delta-9, Delta-10, THCA, or a blend.

2

Check the Amount Per Serving

The total package amount may be much larger than the amount in one gummy, capsule, or measured dropper.

3

Review Laboratory Information

Look for a batch number, QR code, or certificate of analysis from an independent laboratory.

4

Read the Ingredients

Check for allergens, added cannabinoids, caffeine, melatonin, flavorings, and other active ingredients.

Federal and State Rules

Why Hemp Laws Can Be Confusing

Federal law, state law, product chemistry, and changing regulations do not always line up neatly.

Federal Rules

Federal law created a definition of hemp based largely on Delta-9 THC concentration. That definition does not guarantee every hemp-derived product is legal everywhere.

State Rules

States may ban, restrict, regulate, or require special labeling for Delta-8, Delta-10, THCA, and other hemp products.

Rules Can Change

Check current state and local requirements before buying, possessing, traveling with, or shipping hemp products.

Questions to Ask Before Purchasing

Will this product intoxicate me?

Check for THC, THCA, Delta-8, Delta-9, Delta-10, or other potentially intoxicating cannabinoids.

How much is in one serving?

Compare the amount per serving with the total amount in the package.

Is there reliable testing?

Look for current batch-specific laboratory results rather than a generic or outdated report.

Who made it?

Choose products with clear manufacturer information, contact details, ingredients, and lot numbers.

Is it legal where I live?

Availability in a store or online does not automatically prove that a product is legal in every location.

Can I store it safely?

Keep intoxicating products away from children, pets, visitors, and anyone who may mistake them for ordinary food.

Safety

Treat Intoxicating Hemp Products Like Other Cannabis Products

Do not drive or operate machinery after using an intoxicating product.

Start cautiously when trying an unfamiliar cannabinoid or product format.

Keep products in original packaging and away from children and pets.

Be cautious when mixing hemp cannabinoids with alcohol, medications, or other substances.
